Hotel Zátkův dům Information on Personal Data Processing

Operator: Iryna Karpan, ID No.: 226 59 137, with a place of business at Rybářská 2322/41, 370 10 České Budějovice (hereinafter referred to as the "Operator"), as the data controller, hereby informs data subjects about the processing of personal data that it performs in connection with the operation of the hotel Zátkův dům website available at www.zatkuvdum.cz (hereinafter referred to as the "Website"), the conclusion of service contracts with the Operator's clients (hereinafter referred to as "Client" and "Service Contract"), and the conclusion of purchase contracts via the Website with individuals who express interest in concluding them (hereinafter referred to as "Buyer" and "Purchase Contract").

This document contains information about the rights that data subjects have in connection with the aforementioned processing under Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (General Data Protection Regulation, hereinafter referred to as "GDPR") and related legal regulations.

1. Purpose, Title, and Scope of Processed Personal Data

1.1 Conclusion and Fulfillment of Service Contracts

To enable the Operator to negotiate, conclude, and properly fulfill the Service Contract with the Client, the Operator processes the following personal data of the Client – a natural person:

  • Identification data of the Client (name, surname, date of birth, possibly ID number, VAT number, registered address),
  • Contact data of the Client (email, phone number, delivery and billing address),
  • Payment data,
  • Information from communication with the Client, information about the conclusion and fulfillment of the Service Contract.

Without the above data, it is not possible to conclude or fulfill the Service Contract. The legal basis for processing this data is the conclusion and fulfillment of the Service Contract (Article 6(1)(b) GDPR).

1.2 Conclusion and Fulfillment of Purchase Contracts

To enable the Operator to negotiate, conclude, and properly fulfill the Purchase Contract (e.g., for the sale of vouchers), the Operator processes the following personal data of the Buyer a natural person:

  • Identification data of the Buyer (name, surname, date of birth, possibly ID number, VAT number, registered address),
  • Contact data of the Buyer (email, phone number, delivery and billing address),
  • Payment data,
  • Information from communication with the Buyer, information about the conclusion and fulfillment of the Purchase Contract.

Without the above data, it is not possible to conclude or fulfill the Purchase Contract. The legal basis for processing this data is the conclusion and fulfillment of the Purchase Contract (Article 6(1)(b) GDPR).

1.3 Fulfillment of Legal Obligations

One of the legal bases for processing personal data is fulfilling a legal obligation (Article 6(1)(c) GDPR). The Operator processes personal data to the extent required by applicable legal regulations in connection with the obligation to:

  • Maintain accounting and fulfill related tax obligations,
  • Fulfill obligations imposed by Act No. 565/1990 Coll. on local fees (maintaining a register),
  • Fulfill obligations imposed by Act No. 314/2015 Coll. on the residence of foreigners (maintaining a residential register),
  • Fulfill obligations imposed by the Archives Act.

1.4 Legitimate Interests of the Operator

In justified cases, the Operator may process personal data on the basis of the legal title of legitimate interest (Article 6(1)(f) GDPR).

Hotel Monitoring (CCTV System)

A CCTV system is installed in the common areas of the hotel (including the parking areas) through which monitoring occurs. Monitored areas are visibly marked with pictograms indicating the operation of the CCTV system.

  • Purpose: Protection of property, life, and health of individuals in the hotel and its surroundings.
  • Retention Period: Recordings are kept for 72 hours unless an extraordinary event is detected. In the event of an incident, the recording is retained for as long as necessary for investigation.

Other Legitimate Interests

  • Identification of individuals acting on behalf of the legal entity of the Client/Buyer: Processing personal data (name, surname, email, phone) of representatives, employees, or other authorized persons acting on behalf of the Client/Buyer for the purpose of concluding contracts and communication.
  • Proof of consent to the terms and conditions: Retaining a timestamp and IP address in the case of online orders/reservations as proof of contract conclusion and consent to the terms and conditions.
  • Defense and enforcement of legal claims: Ensuring the possibility of procedural defense in potential legal disputes, court proceedings, or inspections by state authorities (e.g., Czech Trade Inspection, Office for Personal Data Protection).

1.5 Sending Commercial Communications

The Operator processes personal data in the scope of email and phone number for the purpose of sending information and news (commercial communications).

  • Clients and Buyers: The legal basis for processing is the legitimate interest of the Operator.
  • Other Individuals: The legal basis for processing is consent given by actively subscribing.

Data subjects have the right to unsubscribe from commercial communications at any time, following the procedure outlined in each sent commercial communication or by contacting the Operator at the contact email.

2. Acquisition and Transfer of Personal Data to Third Parties

The Operator primarily obtains personal data from data subjects (during reservations, inquiries, purchases) and additionally data that arises from the activity of the data subject within the Website (cookies, communication).

Recipients of Personal Data

Personal data may be transferred to:

  • Public authorities as required by law (e.g., Czech Police, Immigration Police).
  • Processors: The Operator uses external processors for data processing, primarily IT system operators for hotel operations (reservation systems) and external accounting services. A detailed list will be provided upon request.
  • Independent controllers, especially payment gateway operators through which online payments are enabled on the Website.

The Operator declares that it has concluded a data processing agreement with the mentioned processors or joint controllers in accordance with Article 28 GDPR to ensure adequate protection of processed personal data. Personal data is not transferred outside the EU, unless stated otherwise (e.g., in connection with global cookie platform operators).

3. Method of Processing Personal Data

Personal data of data subjects is processed primarily in electronic form by automated means using the Operator's IT systems, or in the systems of individual processors. Personal data may also be processed manually in accordance with the relevant purpose (e.g., accounting).

CCTV System: Personal data is captured automatically via the CCTV system, and any evaluation of the recording is manual.

Employees of the Operator, who are obliged to maintain confidentiality regarding personal data and security measures, are involved in the processing of personal data. Personal data is always processed in accordance with applicable legal regulations, ensuring proper care and protection.

4. Duration of Personal Data Processing

4.1 Service Contracts, Purchase Contracts

Personal data is processed for the duration of the conclusion and fulfillment of the respective contract.

4.2 Fulfillment of Legal Obligations

  • Tax and accounting obligations: 5 years from the end of the accounting period; for documents relevant to VAT payments, this is 10 years from the end of the tax period.
  • Evidence of foreigners: 6 years from the last entry in the residential register.
  • Local fees: 6 years from the last entry in the register.

Personal data is archived according to the requirements of the Archives Act.

4.3 Legitimate Interests

  • Defense of legal claims: Even after the termination of the contract, personal data is processed to protect our legitimate interests (defense against potential claims) for the duration of the relevant statutory limitation periods. If no legal proceedings are initiated, we retain this data for 3 years after the termination of the contractual relationship.
  • CCTV systems: Recordings are stored exclusively for the duration necessary for the specified purpose of processing, typically 72 hours.

4.4 Sending Commercial Communications

Personal data is processed until the data subject unsubscribes from them as described above.

5. Rights of Data Subjects

The data subject has the right to:

  • Right of Access: Request access to their personal data and request a copy of all processed personal data.
  • Right of Rectification: Request the removal of any inaccuracies, including corrections, additions, or updates to personal data.
  • Right to Erasure (Right to be Forgotten): Request the deletion of personal data if the purpose of processing has ceased or consent has been revoked.
  • Right to Restrict Processing: Request the restriction of processing of personal data.
  • Right to Data Portability: Request personal data concerning the data subject in a structured, commonly used, and machine-readable format, and transfer this data to another controller.
  • Right to Object: Object to the processing of personal data that is carried out based on legitimate interest.
  • Right to Withdraw Consent: Previously granted consent for processing can be freely revoked at any time via the Operator's contact email.
  • Right to Lodge a Complaint: Submit a query or complaint to the Office for Personal Data Protection (www.uoou.cz).

6. Measures for Securing Personal Data

To protect the processed personal data, the following security measures are primarily used: implementation and enforcement of internal regulations on personal data protection, antivirus protection, firewalls, encryption, access control to personal data and authorization data, backups, physical security measures, and others.

Zátkův dům is located in the historic center of České Budějovice on Krajinská Street, where it stands as a dignified reminder of the city’s celebrated past and the distinguished Zátka family. The building sits on a relatively wide plot and contains a medieval core; its origins can be dated to the late 14th century, as it shows the main features of mature Gothic layout. The house underwent extensive changes, including Gothic phases and a Renaissance reconstruction in the second half of the 16th century.

Today’s hotel occupies two originally Gothic houses that once stood directly by the city walls next to the Prague Gate. This location had strategic importance for the defense of the city from the northern Prague side.

Inside the house a Renaissance fresco of an unknown martyr has been preserved, depicting God the Father and his son Jesus Christ beneath a canopy of clouds (circa 1550). It is one of the best-preserved frescoes of this type from the 16th century in České Budějovice.

In this house in 1847 JUDr. August Zátka was born — a prominent politician, lawyer, member of the Czech Provincial Assembly, and one of the main leaders of the Budějovice Czechs. The house bears his name thanks to his merits. Zátka helped found the city brewery, an enamelware factory, and a number of cultural and economic institutions. In 1906 he led the Czech inhabitants of Budějovice to their first victory over the Germans in the municipal elections — twenty thousand people marched past his windows with lanterns in celebration.

The Zátka family, however, left a much broader mark across the whole of South Bohemia. August’s father, Hynek Zátka, was a pioneer of modern entrepreneurship — he established a business in salt and flour products and in 1869 built the first steam-powered mill in South Bohemia. His sons Vlastimil and Dobroslav opened the first pasta factory in Central Europe here in 1884. Zátka pasta soon became a household name and was exported to many countries. It still operates today as part of Europasta SE.

Despite two world wars, the confiscation of property by the Nazis and subsequent nationalization by the communists, the Zátka name remained synonymous with enterprise, education and love of South Bohemia. Today our hotel carries on the legacy of this famous family.

Arrival by car

Arrival to the hotel is through a pedestrian zone To make your arrival as easy as possible, we have prepared some important information.

Arrival through the pedestrian zone

You enter our hotel through a pedestrian zone. Don’t worry—the entrance is permitted for hotel guests (vehicles up to 3.5 t parking in the property).

If approached by the municipal or state police, just say you are heading to the hotel courtyard at Krajinská 41. After arrival we will issue you a parking card for the duration of your stay.

Pedestrian zone rules

The hotel is located right at the beginning of the pedestrian zone. When driving through, please follow its rules:

Give absolute priority to pedestrians.

Be extra cautious of cyclists.

Observe the maximum permitted speed of 20 km/h.

Please do not arrive before check-in time.

To ensure smooth traffic flow in the pedestrian zone and the hotel car park, we recommend arriving at check-in time. Please do not park or stop for extended periods in the pedestrian zone if entry to our parking is not yet possible. Alternatively, call us about earlier access.

It may happen that the hotel car park is temporarily full if departing guests are still leaving.
